1. Detailed Specifications Or Brief

GetNeat ID will develop specifications of all works to be done as detailed with their own style of plans and 3D drawings where applicable.

Specifications usually include, but not limited to, interior specification colour schemes, fabric choices, proposed lighting, furniture, and furnishings and all other design and interior design construction work as is required for the project. These will be agreed upon at the initial meeting and forms the foundations for the project.

2. Scope of Work Or What Needs Doing

This is where GetNeat ID will detail the list of works to be carried out and provide an estimated process for the order of works. GetNeat ID uses a fixed fee pricing structure, so the scope of work will be comprehensive and spell out what will be done and delivered to the client. This will then form a documented and strong understanding, between both parties and clearly set out the role for GetNeat ID.

From project to project, it must be noted that GetNeat ID’s labour, does not include services from contractors such as architectural, plumbing, lighting, and engineering contractors, and neither will they include modifications and alterations to structural, plumbing, heating, electrical, air conditioning, or ventilation systems in the design project. These are usually specialist works that are arranged and managed by GetNeat ID on behalf of the client. Professionals in the field are brought in and GetNeat ID shall collaborate with them on behalf of the client to ensure the outcome is reached.

3. Drawings Or Presentations

2D, 3D, renders, animations, mood boards and scope of works will all form part of the agreement form between both parties. However, the client must understand that drawings are only conceptual and serve as a design concept document and not to be used for other purposes. Please refer to the Intellectual property section on the terms and conditions page.

The client must then ensure that they provide accurate information to GetNeat ID. There will be a clear statement affirming that all digital or hard copies and other attached documents must not be used by Client for any purpose other than what is laid out in the interior design agreement. Rights to these documents are only released to the client on receipt of payment.

4. Consultants and Contractors Or Project management

It can sometimes get confusing communicating with all the different contributors to the projects, so GetNeat ID shall supervise and project manage, for conformity to the design concept on behalf of the client and communicate with all parties involved.

5. Design Fees Or Pricing structure

GetNeat ID agreement form will also include the fee structure and how charges will be made, and when each payment stage will be implemented. The client must pay, according to the terms, when an invoice is presented.

Upon signing the agreement, a client shall pay GetNeat ID a non-refundable deposit which establishes a minimum fee for all design Services. This deposit will be credited against all fees payable to GetNeat ID upon completion of the project.

GetNeat ID strives to provide a fixed price contract, which is why we agree upon all aspects of the design process works and will be very clear on how and when we charge. This will be clearly stated in the agreement papers and we push to eradicate all assumptions prior to work commencing, so that they do not cause frustrations or delays somewhere down the line.

6. Guarantees Price Guarantees, Warranties (or Not)

GetNeat ID will only provide a warranty, guarantee, or certification of their part of the project and will be responsible for the quality of their works, materials used, their performance, and their duration of works.

When a contract requires the input of outside consultants and professionals, the client will enter into a separate contract for their services. The outside contractors will then provide a warranty, guarantee, or certification of their part of the project and will be responsible for the quality of their works, materials used, their performance, and their duration of works.

GetNeat ID cannot guarantee prices of merchandise, interior installation, or other services not performed by them. Contractor pricing is sometimes subject to change, and if the client is indecisive or unsure, takes longer than is necessary to make a firm decision, a contractor’s change in price will be out of the designer’s control. We will make you aware what is fixed and what is subject to change.

Only when all works are confirmed and security deposits received, will the prices be fixed and guaranteed.

7. Purchasing and Procurement or Ordering parts

GetNeat ID will only place orders or procure goods on behalf of a client when a confirmation and payment is received. In most cases, we include the breakdown of any finances required prior to installation, as well as any payments to vendors which require full payment, when an order is placed. The Client is then expected to pay in full for such goods. It will be stated so in the agreement form.

From time to time we may also give specification to the client in cases where it makes more sense to order direct.

8. Refunds

Once furniture or furnishing items have been confirmed and purchased on behalf of the client, most items bought cannot be returned. This includes customised, digital and specially produced items. If the client is indecisive or unsure, takes longer than is necessary to make a firm decision, a change in price will be out of the designer’s control and any losses incurred by the designer from the client, will be investigated for re-imbursement.

9. Cancellations

Cancellations of orders placed after the signing of the contract with GetNeat ID cannot be affected. And when a client wishes to cancel an already agreed-upon order, he or she will be responsible for payment requests to cover cancellation costs which may be billed hourly, depending on the interior designer and project.

In some instances, requests to cancel will be assessed on a per-project basis with no guarantees of cancellation or fees returned. These are a couple of the reasons why design documentation and contracts are important. Interior designers must make sure clients confirm and approve by signing their chosen proposals before any purchase.

10. Reimbursable Expenses

GetNeat ID’s contract agreement forms have a clause that indicates a client agrees to reimburse the designer for any out-of-pocket expenses incurred by them in relation to the interior design project. This may include things like drafting or renderings services, freight and/or postage charges, and delivery and/or storage costs.

There must also be a reimbursable expense for travel, meal, and lodging if and where necessary, if it is in connection with the contract. These are all usually accounted for when the proposal is presented.

11. Payments and Payment Terms

If GetNeat ID does not present a client with the expected payment terms before a contract agreement is signed, the client will be in the dark as to when it is right (or wrong) to pay for services rendered and believe they can pay whenever.

GetNeat ID will clearly set this out in the interior design agreement. It is also important to note in the agreement that invoices due more than 7days days will accrue late fee charges. GetNeat ID may also state that all work will cease, and the delivery of items withheld until all due invoices are cleared.

12. Insurance

There must be insurance coverage for all interior design furnishings, furniture, and all other materials during handling, moving, installations. It must be made clear in the agreement documents that the client is responsible for its payment. The cover must also include for the interior designer.

A client must not work without insurance and an interior design professional will not allow works to commence without adequate insurance cover by the client. This is important, especially when working on medium to large projects.

13. Photographing Completed Works

For the interior designer’s portfolio of works, GetNeat ID website or any other marketing and advertising scenarios, the client must agree and allow the designer to photograph the project through all its stages of works and after the project is completed for ‘before, during and after’ pictures.

If the photographs will be used for business or publicity reasons like posting online, on social media, or for marketing and advertising, the interior designer must agree not to disclose the client’s name or address without prior consent.

      4. On receipt of the returned Products, if we prove them to be faulty, damaged or incorrect, we will provide you with a replacement within a reasonable time and will reimburse you for the postage costs in returning them to us;

      5. In certain circumstances, where a replacement is impossible or otherwise disproportionate, we may instead offer you a full refund, including any delivery costs paid by you when the Products were originally purchased;

      6. If you request a replacement during the 30 calendar day rejection period, that period will be suspended while we carry out the replacement and will resume on the day that you receive the replacement Products;

      7. Please note that you will not be eligible to claim under this clause 6 if we informed you of the fault(s), damage or other problems with the Products before you purchased them (and it is because of the same issue that you now wish to return them); you have purchased the Products for an unsuitable purpose that is neither obvious nor made known to us and the problem has resulted from your use of the Products for that purpose; or the problem is the result of normal wear and tear, misuse or intentional or careless damage. Please also note that you may not return Products to us under this clause 7 merely because you have changed your mind.  If you are a consumer in the European Union you have a legal right to a 14 calendar day cooling off period within which you can return Products for this reason.

  3. Refunds under this clause 6 will be issued within 14 calendar days of the day on which we agree that you are entitled to the refund, using the same payment method that you used when purchasing the Products, unless you specifically request that we make a refund using a different method.

  4. For further information on your rights as a consumer, please contact your local Citizens’ Advice Bureau or Trading Standards Office.

7. Cancellation Within the Cooling Off Period

  1. If you are a Consumer, you have a statutory right to a “cooling off” period within which you can cancel the Contract for any reason, including if you have changed your mind, and receive a refund.

  2. In the case of Services, this period begins once the Contract between you and us is formed and ends at the end of 14 calendar days after that date.  If you wish to cancel the Contract within the cooling off period, you should inform us immediately by post or email.

  3. If you wish for our Services to start within the cooling off period, you must make an express request for us to do so.  You acknowledge and agree that if you do so, you will lose your right to cancel if our Services are completed within the 14 day cooling off period.  If we have begun providing our Services, you will be required to pay for the Services we have provided up to the point at which you inform us of your wish to cancel.

  4. In the case of physical Products:

      1. the period begins once we have sent you your Order Confirmation (i.e. when the Contract between you and us is formed) and if the Products are being delivered to you in a single instalment (whether single or multiple items), the cooling off period ends 14 calendar days after the day on which you receive the Products.  If the Products are being delivered in separate instalments on separate days, the cooling off period ends 14 calendar days after the day on which you receive the final instalment of Products;

      2. Please ensure that you return Products to us no more than 14 calendar days after the day on which you have informed us that you wish to cancel under this clause 8;

      3. You may return Products to us by post or another suitable delivery service of your choice to our returns address provided with the Products.  Please note that you must bear the costs of returning Products to us if cancelling under this clause 7;

      4. Refunds under this clause will be issued to you within 14 calendar days from the day on which we receive the Products back; or the day on which you inform us (supplying evidence) that you have sent the Products back; or if we have not yet dispatched the Products, the day on which you inform us that you wish to cancel the Contract;

      5. Refunds may be reduced for any diminished value in the Products resulting from your excessive handling of them.  Excessive handling means any more handling than is reasonably required to ascertain the nature and characteristics of the Products in question (e.g. no more than would be permitted in a shop).  Please note that if we issue a refund before we have received the Products and have had a chance to inspect them, we may subsequently charge you an appropriate sum if we find that the Products have been handled in a way that would otherwise entitle us to reduce your refund.

  5. If you wish to exercise your right to cancel under this clause 7, you may inform us of your cancellation in any way you wish.  You may use our Model Cancellation Form, but you do not have to.  To meet the cancellation deadline, it is sufficient for you to send your cancellation notice before the cancellation period has expired.  If you do so, we will refund any sums paid to us under the Contract within 14 days, using the same method you used to make payment, unless you request otherwise.

8. Cancellation After the Cooling Off Period and for Business Clients

  1. After the expiry of the cooling off period set out in clause 7 or if you are not a Consumer, you are required to provide us with a minimum of 14 days’ written notice if you wish to cancel the Contract.  In the event of cancellation, we will invoice you for the Services provided up to the date of cancellation.  Upon receipt of payment, we will hand over all works completed by us up to the date of cancellation in relation to the Contract.

  2. Either Party may cancel the Contract immediately if the other:

      1. has committed a material breach of this Contract, unless the breach is capable of remedy, in which case this right to terminate will be exercisable if the other Party has failed to remedy the breach within 14 days after a written notice to do so; or

      2. goes into bankruptcy or liquidation either voluntary or compulsory (save for the purposes of bona fide corporate reconstruction or amalgamation) or if a receiver is appointed in respect of the whole or any part of its assets.

  3. Cancellation of the Contract for any reason will not affect the rights and liabilities of the Parties already accrued at that time and any clauses that are stated to continue in force after termination will not be effected.

  4. We will be working with the client’s budget. On occasion, freight and delivery charges are not known until the end of the lead-time. Prices of furnishings and other products are subject to change.  We cannot be held liable for additional or unforeseen costs.

  5. Delays due to contractors/builders or site delays whilst we are undertaking a project management role cannot be claimed against us.

9. Our Liability

  1. We will be responsible for any foreseeable loss or damage that you may suffer as a result of our breach of these Terms and Conditions or as a result of our negligence.  Loss or damage is foreseeable if it is an obvious consequence of our breach or negligence or if it is contemplated by you and us when the Contract is created.  We will not be responsible for any loss or damage that is not foreseeable.

  2. If you are not a Consumer, we will not be responsible to you for any loss of profit, loss of business, interruption to business, loss of any business opportunity or for any other indirect or consequential loss.  In the event of a breach by us of our express obligations under these Terms and Conditions, your remedies will be limited to damages, which in any event, will not exceed the fees paid by you for the Services.

  3. The Contract is between you and us.  It is not intended to benefit any other person or third party in any way and no such person or party will be entitled to enforce any provision of these Terms and Conditions.

  4. If any of the provisions of these Terms and Conditions are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, that/those provision(s) will be deemed severed from the remainder of these Terms and Conditions and the remainder will be valid and enforceable.

  5. No failure or delay by us in exercising any of our rights under these Terms and Conditions means that we have waived that right, and no waiver by us of a breach of any provision of these Terms and Conditions means that we will waive any subsequent breach of the same or any other provision.
